Insane construction noise at 7.30am on weekends - what to do?

Ok, so here's my issue. I live on the 6th floor of a new (it opened late last year) 38 floor apartment building. Over the past three weekends, there's been hellish hammering and drilling noise from a construction site in our building directly below our apartment that starts at between 7.30-8am on Saturday and Sunday. It's a really deep percussion noise that travels through the walls, through earplugs, through anything and sleep is absolutely impossible while it's going on. What's more, the workers tend to hammer away for five or ten minutes, then stop for half an hour - just long enough for you to start drifting off to sleep once more - then they start up again. Wash, rinse, repeat, until you're in a homocidal rage.

Last weekend we went to complain at the manager's office, who took us to two building sites. The first one is located directly under our apartment. When we got there, the cops were already on site with security guards, who had obviously received complaints from other residents. The workers there swore black and blue that it wasn't them - they showed us punch cards that stated they'd clocked on at 8.30, yet the noise started well before then - and claimed they weren't using hammers. They blamed it on another construction site in the building. I felt sure it was them. Then we went to the other site, located way over on the opposite side of the building in an annex adjoining the tower we live in. Here, there was very audible hammering noise, but I could not see how that noise could travel so far.

Anyway, same problem this weekend. We went back to the site below us to complain again - I'm sure it's them. I've heard hammering noises coming from there when I've stood outside the building, underneath their window. I've also done some discreet recon work in the site and they are indeed using hammers when they think no one is checking on them. The building management also claims the noise is coming from there. Trouble is, they say they can't do anything about it. They say the cops can't do anything about it, either. All they can do is ask the builders not to use the hammer and drill on weekends. The foreman there initially denied everything, was visibly angry and then - according to the building manager who speaks a bit of English - apologised to us and promised to keep the noise down. There was a slight improvement, but still regular hammering.

Personally, I don't care if the workers hammer and drill during the weekdays, but on weekends it should be RIGHT OUT until the afternoon. And I know other people in the apartment building are complaining, too. The noise being made can wake the dead, and the builders reckon they're going to be at it for another two months. Do I really have to go through 8 more weekends of early nights and early starts? Surely there is an authority I can complain to with some teeth that will force those damn builders to afford the residents of this building some peace over the weekend?

So you want all construction activity in Beijing to cease just so you can sleep in on the weekend?

Sounds very reasonable to me.

Read it again carefully, Wavey. The construction is inside my building, just below my apartment, not on the other side of town. I pay a fair bit of money to live here and I expect to be able to sleep past 7.30am on the weekend and also spend time in my apartment without being deafened by hammering and drilling.

Sound reasonable enough for you now?

BS, their job is too handle complaints like this. Get on their back, my property management always helped out with things like this (after long and painful conversations of course).

You would think so, right? Believe me, we have been getting on their backs. They say that the site under construction is not within their purview - it's not on a residential floor of the building - apartments start on level 6 and this is on the floor below. It's a big area that takes up half of one floor. I guess it's for offices? Anyway, the building management called the police last weekend and the weekend before. The foreman got pissed off, then apologised, the cops left and the noise started up again half an hour later.

Yeah, they will ussually start about 1/2 an hour after they leave unfortunately. My BS statement wasn't directed at you, so much as your BS'ing property management.

Of the latter, the third article is useful - unfortunately, weekend work is only restricted where noise activity occurs in residential buildings where renovations are involved - see article 35 below.

(第三十五条 法定休息日、节假日全天及工作日12时至14时、18时至次日8时,禁止在已竣工交付使用的居民住宅楼内进行产生噪声的装修作业。在其他时段内进行装修作业的,应当采取措施,减轻对周围生活环境的干扰。)

Articles 16 and 38 may be useful as well - see below:

(第十六条 施工单位应当制定施工现场噪声污染防治管理制度并公告,把产生噪声的设备、设施布置在远离居住区的一侧。)

(第三十八条 违反本办法第十六条规定,施工单位未制定施工现场噪声污染防治管理制度,未把产生噪声的设备、设施布置在远离居住区一侧的,由城市管理综合执法部门责令改正,并可处1万元以上3万元以下罚款。)

I will tell you from experience that simply citing the law to the WuYe or the police is not efficient - you have to contact the Beijing EPA (http://www.bjepb.gov.cn/bjhb/portal0/default.htm) and here to complain (http://219.237.206.84/12369web/Index.asp).

In addition to calling them and letting them know, it might help to have someone who is Chinese speak with the BJ EPA and explain what the issue is, how long it's been happening, whether it's been reported before to the police, and stress the regulations and that it is illegal, citing the actual dollar amounts. I know it sounds like much but it's better when you do their job for them and all they have to do is send someone out to investigate and fine the culprits. If the police do wind up coming out as well, you can use the regs to your advantage AND to their advantage by pointing out the amounts of the fines - when money is involved, especially that much money, that should get things rolling.

That should cover me, then...it's a residential building that's completed - they're refitting a floor below mine...

The funny thing is that I know there are other (Chinese) residents in the building who are complaining, too. Surely they know what to do and who to speak to to get the builders to quieten down a bit (a lot)?

I quite enjoy Mading's diarrhea-like rants, actually. The last time I came across him he claimed he was an English tutor who can be hired for RMB150/hr for his services, then proceeded to "correct" everyone else's English. Brilliant!

So it is in your building - meaning it's not 'below' your building? If so, then you're all set - there is one catch though. They may have applied for and received a permit to do construction on the weekends (I'd check though - sounds like your WuYe might not be on top of things so even if you go through them that'd probably be a waste of time) but it's doubtful.

Might I ask where your building is located (not for stalker purposes but looking for property at the moment and don't want to move into a 'construction zone')?

Well, it's definitely in our building - although the residential part starts on level 6 (my level). Underneath is for offices or something. The construction site that's causing all the racket occupies the two floors directly below mine. This is not a residential part of the building - I guess they're making offices, because they're knocking down walls and are occupying at least half of the floors they're on.

I live in the new Pingod building in the CBD - 32 Baiziwan Rd. The apartments in the building itself are very good and if you took an apartment on a high floor, there would be no problem. What kind of place are you looking for?

I think you completely miss the point. On a construction site most activities do not make noise. Just a few do.

No idea about the law in China, but in Hong Kong any power equipment use is illegal an Sundays and outside weekdays work hours (I forgot the exact schedule). That law works well and Hong Kong still has plenty of construction.

Side note: when I came back to my hotel in BJ one night at 23:00 I saw this cement pump right next to my window waiting for the next cement truck to arrive. Looked like all night construction activities. Was no problem to get a new room away from that site. Days Inn Forbidden City really has excellent service.

Drink really, really heavily. Then you can sleep through anything. Add a handful of pills if that doesn't work.

I was living there when I contacted the property management about early morning/late night reapairs. Did manage to get it stopped. But yeah, people are doing repairs there all the time.

Good luck, there is no real law here and what laws they have are not enforced because of the general laziness of 99.9% of anyone in any position of authority here. Of the ones who aren't lazy, the rest are afraid of getting their kneecaps busted by thugs who were hired by some connected guy who doesn't like them actually enforcing the laws.

just as disturbing as the construction noise outside my side or even more in that case is the girl who lives in the apartment above me. I guess her bf broke up with her or banged some other chick and she found out, I've never heard anybody crying that hysterically for such a long time. I honestly was about to go up there and tell her to stop yelling and squealing and crying and stomping her feet, cuz I really wanted to sleep!

After carefully reading it again, yes it does sound 'reasonable' enough.

Stop being so weak as piss.
Sometimes direct and simple negotiation with construction workers is more effective than crying your hole out to their boss or authorities who will just sit on their hands.
My tried and tested method - Offer them some beers for when they finish the day if they can start a little later. I'm sure if you 'pay a fair bit to live where you are' then you could chop a few yuan for a beer or two.

Or maybe just cop it and get up at what I'm sure most people would consider a 'reasonable' time. I'm sure that if they started at 0930 there would be another sook in your building which wants to sleep in until 1030.

Alternatively, they could comprehend that they're working in a residential building and the residents have a legal right to live in an abode that isn't constantly ringing with deafening construction noise. Seriously, I really don't think you realise how noisy they are. I'm sure if you knew, you wouldn't be here telling me to stop making such a big deal.

all you can do is complain to the management and the workers as much as you can and hoping for the best, which is that they'll actually stop hammering and drilling on weekends. or they'll just keep apologizing and promising and still do the same. then you go back and complain again and again until they finally do what they promise. no other way around it.

i've never lived in a place in beijing without having to put up with construction noises. some were really unbearable. i lived in dongzhimen area for about three years and had approximately 3 months of quiet days. have to get used to it or you'll go insane.
