Children born from mixed couples in China are Chinese/ One-child policy now applies to such couples WTH???

(Not sure you can actually say "mixed couple" in English, please correct me if I'm wrong)

I'll try to make it simple, although I'm quite upset atm.

My wife is Chinese and I'm European and we're planning to have a baby this year, so lately we started looking for pratical informations about visa/nationality issues for babies born from mixed couples in China. Since my wife works in an ambassy, she simply asked some of her colleagues about that and well, the answer she got is indeed stunning, see for yourself!
According to what they told her, the chinese law concerning this particular matter is quite ancient but has never been enforced until very recently. China actually considers any child born here as Chinese and therefore the one-child policy is applicable just like it is for 100% han couples. When my wife told me about that I just laughed at her until this morning when I decided to check it out for myself. Some European newspapers have reported (as recently as last week) cases in which Westerners living in China have faced the consequences of the new enforcement if this law. One of my fellow countryman reported on a forum that as he tried to apply for a resident visa for his baby last month the official just told him that he didn't need to apply since his kid was Chinese. He also told him that he could see on his personal visa that he already had a kid with his Chinese wife in China and therefore he was breaking the law. He was fined 32.000 dollars for that. Apparently the fine depends on the district you live in and the average income there, in that case it's Chaoyang district in Beijing.

According to the report I've read, the same story has been happening to US citizens, Canadians, Australians, etc.

I think China's gvt is pushing it too far this time!!! I'm ok to comply with Chinese laws as long as China respects my basic rights as a foreigner, and I think me and my wife should be the only ones deciding wether our children should be Chinese or not, and how many kids we should have.

What's your opinion? Have you heard about this?

As far as the one-child policy, doesn't Shanghai have a two-child policy?

Well I take it "mixed couple" is correct then, thank you. I'm not moving to Shanghai, no matter what. We both have stable jobs in Beijing, so Shanghai policy is of little help in our case, thank you though

This is not Europe or the US,you must follow the law and stop complaining,besides you chose to marry a Chinese woman,so face the music okay?

Apparently, a month ago. It is indeed a big change and it's still unclear how you can avoid this but I'm sure there are ways.

If you choose to make your children citizens of your own country, as I did, then the Chinese law has no affect on you. Not even if you add the child to your household registry.

If you want your baby to grow up in china then you are in the crap. innit..if not, your future baby is european.

That doesn't quite ring true.
Examine:

1) A citizen of the PRC is not allowed to be a citizen of any other country. If they are, they relinquish their PRC citizenship.
2) As the child of a European, they have the right to citizenship from your country.
3) Give them a passport from your country. Theoretically, they are legally required to give up their PRC citizenship.
4) They are not Chinese anymore, and hence not bound by the same laws.

Furthermore, I'm pretty sure I remember reading the full details of the single-child policy somewhere... and there was something in there about a child of a chinese+foreigner not being bound by the same rules. Don't remember the specifics.

Note: I'm not a lawyer; don't take my word on it.

Sometimes I feel it is maybe unbearable always be traditional Chinese girl.

Yes, I've been looking a bit more into this and in my case I have 3 days after the baby is born to go to the ambassy and do that. Maybe the people reporting this story forgot to do the paperwork in due time, thinking they could do it later?

You're right about China not allowing double citizenship, and I heard the same thing you have about the single-child policy not applicable to mixed couples, hence the surprise when I read about these reports. For now I'd say it's just reporters that got something wrong or forgot to mention some paperwork wasn't done as it was supposed to. If anyone knows more about this, feel free to share the information with me here.
