Some records check websites do not have access to criminal records in every state. DMV records are totally different than criminal records.

Come on ... just think logically for a moment, will you?

First of all, they also ask if you have TB, HIV and a number of other ailments. Have they taken a blood sample from you? Do you think they can do it via osmosis?

Secondly, running a criminal records check costs money. Do you actually think they're going to spend several million $$ running background checks on every individual who goes to China?

You can do what you want to do and I am not suggesting you lie. But I am telling you that whatever you fill out on that visa application they pretty much have to take your word for it.

The Chinese visa is a small thing. I would be more concerned about future employment if I were you.

A better investment of your time and money (than coming to China) would be to get your record expunged, if the local law allows...

Expunged means it would be closed to the public. The record is still there, but no one can see it. For all practical purposes it's gone.

Do you personally have to go before the judge? In Indiana people can petition the court, and if the prosecuting attorney doesn't object, the court can simply issue an order.

I am not saying that the prosecutor won't object, but maybe you don't need to be there?

Did you have a lawyer when you entered your guilty plea? Were you advised of your rights before you entered the plea? It sounds vaguely to me like this might have been a mutual combat situation, where neither party was criminally-culpable. If that was the case, you may have had a defense, and perhaps the prosecutor should not have filed. Not being advised of your rights before pleading could be a violation of your constitutional rights. If the PD has nothing better to do s/he should check the record of your arraignment and GP, to be sure you were read all your rights.

(This constitution stuff is not a technicality...)

I think you should add an explanation. Just tell them the truth. Tell them you are incredibly stupid and wonder if they still want you to come.

I am sure they will agree about how stupid you are. So this should not be a problem.
