Before getting a membership at Ozone fitness, you may want to investigate other centers, Ozone has just closed its 'flagship' branch at Park Avenue on its members, and is refusing to reimburse members, even those who bought only one week before the closure. Does not bode well for other clubs nor for general attitude of Ozone towards its members.

LETTER OF PROTEST
  
To: Howard T. Quach, Founder of Beijing Ozone Fitness Co. Ltd. (“Ozone”)
       Tomer Rothschild, CEO of Beijing Ozone Fitness Co. Ltd.
 
We, the members of Beijing Ozone Fitness Co. Ltd.’s Park Avenue Branch (“Ozone Park Avenue”), hereby submit our demands as follows:
 
WHEREAS:-
1.                  Ozone Park Avenue closed down abruptly without any advanced notice on 6 March 2010;
2.                  The notice posted on the sealed door stipulated that Ozone Park Avenue members would be transferred to other branches of Ozone.  However, we members joined Ozone Park Avenue on the premise that its location is convenient to us.  Transferring to other branches, none of which is within walking distance, would create a huge inconvenience and is not in line with our reasons for joining Ozone Park Avenue.  We do not agree to such an arrangement;
3.                  That Ozone itself sealed its premises signifies that it was Ozone’s decision to close down the branch.  It is arguable that Ozone’s Management had known about the imminent closing of the branch.  However, Ozone Park Avenue continued to aggressively promote, sign on new members and renew existing memberships in the run up to 6 March 2010.  Members received mobile texts and telephone calls about special promotions and sales in February 2010.  There are members who joined and made payments just several days before 6 March 2010; 
4.                  No decision maker from Ozone has explained matters to us to date.  No written or verbal notices have been given to members to date; and
5.                  We strongly censure Ozone’s unethical and unprofessional behavior and Ozone’s mishandling of its members.
 
DEMANDS:-
1.The legal representative of Ozone is to offer a public statement on the reasons for Ozone Park Avenue’s closure, and to offer a public apology to the members;
2.Ozone is to offer a refund for the services for which we made payment but which we did not receive, including membership fees and personal training sessions; and
3.Ozone is to compensate members for losses incurred in the abrupt closure of Ozone Park Avenue.
 
We demand a reply from the legal representative of Ozone by 16 March 2010.
 
In the run up to World Consumer Rights Day on March 15, both the Chinese media and the citizens are paying particular attention to consumer protection.  In view of Ozone Park Avenue’s closure without reasonable notice and legitimate cause and without fulfilling your obligation to provide us with reasonable services, we reserve the right to take further action in order to protect our rights as consumers.
