I NEED ADVICE :(

My current employer terminated my contract, so I work only until next month. I was advised that my Foreign Expert Certificate will have to be canceled, and a new employer will have to apply for its renewal. I heard from fellow Filipino friends, who are also working as ESL teachers, that I'd have to exit China if that's the case. Then my Foreign Expert Certificate would be renewed.

I have been here for four months now, and any advice or tip on the matter is appreciated. My Res Permit is valid for the next three months, but canceling my Foreign expert certificate would affect it, right? Does that mean I need to get a new Visa? And apply for another Res Permit?

It would be costly for me to have to exit the country, and I am still in the process of finding a new employer.

Hi,

Sorry I dont have any advice, but keep your chin up and continue to look for an employer. If it gets too close to the expiration of your job, you may just have to bite the bullet and make a trip to HK. Also, there are numerous visa agencies who can help you out.

A somewhat related thing happened to me about 6 years ago. I thought I had a job and was communicating with a public school official. Turned out it was just a recruiter posing as one. There was no job. I showed up in the city of Lanzhou with 4 huge bags and found no one waiting for me. I had one month of visa left, no job, schools and univs closed because of vacation, and I was in a city that i had never been to before. I started talking to everyone about a job. I visited almost all the schools and univs even though most were closed. At that time it was a terrible experience. Now that some time has passed, I shrug it off.

Anyway, just wanted to encourage you. Also, the contract may have been terminated for a reason. Work on it and improve.

So far, I'd been offered part-time jobs and I doubt they would help me with Visa.
I need all the luck I can get.

Normally cancelling your FEC does not directly effect your residence permit. You should be able to stay in China up to the expiration of the residence permit.

The usual process when switching employers is that the old employer gives you a release letter / letter of recommendation and with that the new employer applies for your new FEC. With the new FEC the new employer asks the PSB to reissue your residence permit.

However, with Filipinos it is likely very different. I'm not sure why, but it seems authorities go out of their way to make things exceptionally difficult for those from the Philippines and Indonesia.

Thanks gdbill. Would there be any fine or sanctions for living in China with a cancelled FEC? My new employer is applying for a new one for me next month but I was informed by my former company that they cancelled my FEC already..

Since the FEC only controls employment, you can live in China with an expired or canceled FEC, but just not work.

You need to ask for the cancellation receipt of your FEC and get a release lettter from your previous company. With these in hand, it will be easier for your new employer to apply a visa and FEC.
