chinese visa with criminal records

My partner and I are planning to go back to China next year to have a wedding there with my families and friends. I am a Chinese Citizen and NZ Permanent Resident and my partner is NZ Citizen.

He has been to China for a month in 2008 on a visitor’s visa. But the problem here is he got convicted with driving under the influence, misuse of drugs and in the possession of utensils (marijuana related) in 2010. He went to court for that, and the penalty was 40 hours community work and suspend driving license as well as fines. In September this year, when he went to Australia for work, he has been stopped at custom for a brief interview with the officers; they asked him a few questions in regards to his conviction happened in 2010. Then they let him through with no problems. He is still working in Australia currently and will be back on 13th this month.

Will he have any trouble of getting a Chinese visa? Because all my families and friends are still back in China, having a wedding in China is really important for all of us. Is there any way that he can get it this time, we are willing to do anything to make this trip happen.

On the visitor visa application there is a question that asks if the applicant has been convicted of any crimes. Playing by the rules, he would have to tick a "yes" to that question. Then it's up to the consulate/embassy on whether they decide to admit him. They might ask for a criminal record, or they might just outright deny his visa application. I'm willing to be it's the later.

You can always lie and try ticking "no" for the above question on the application form. I'm not sure how often they actually do random background checks on visa applicants, but it can't be that often. Fact is if they issue the visa, he should be able to get past Chinese customs without any problem.
