AmCham China member companies face complex cyber security related compliance concerns in China – especially as it relates to the regulation of the Internet and online systems.

The Standing Committee of the National People's Congress passed China's Cybersecurity Law on November 7, 2016, which officially entered into effect on June 1, 2017, and has continued to release implementation guidelines. The law establishes a comprehensive regulatory regime for cyber security, formalizes legal responsibilities for "network operators" and "network service providers," and develops regulatory supervision in a systematic way. The law will regulate all network services and activities within China, including construction, operation, maintenance, and usage of networks.

Many American companies have concerns about how to comply with various aspects of the law from ICT products to solutions and services, especially data localization requirements, the restriction of cross-border data flows, security review processes, and requirements to share data and provide technical support and assistance to law enforcement agencies when requested.
